Terms and conditions

Hereinafter referred to as Away4.

The term Customer means a user created on a of Away4 services offered, including but not limited to,, regardless of whether the Customer participates in a trial period, free service or payment, or a combination thereof. Away4 and Customer are designated collectively Parties or Parties.

Any delivery between the Parties takes place on the basis of these Terms and Conditions of Sale. Activation of trial period, test, payment period or equivalent activation of a service provided by Away4 is perceived as a delivery and thus acceptance of the present Terms and Conditions of Sale. Customer agrees to receive ongoing news emails with information about, including but not limited to functionality, terms, tips & tricks, campaigns, and operating information. News messages can be unsubscribed at any time via Away4. The Customer agrees at the same time that the Customer’s Company Name and logo may be freely used by Away4 for reference use on the web, newsletters and the like.

Away4 reserves the right to all services offered. Possibly. Abuse or violation of property may lead to legal proceedings.

Away4 manages the development of all services offered and the Customer can not at any time request changes in the product, but may request it in writing.

In case of default, Away4 is entitled to stop further deliveries and demand replacement. In the event of default, including but not limited to Customer’s non-payment, abuse of Away4 services, bankruptcy, liquidation or suspension of payments, with which Away4 is entitled to cancel immediately the agreement.
If Customer has exceeded their payment for offered services with 5 business days, Away4 is entitled to close for access to the service with 3 working days notice. Access to the service is reopened once the amount due has been paid. If the payment is exceeded by 10 business days, Away4 may terminate the service without notice and access to the service will be reopened once the amount due has been paid. If payment has been exceeded with 20 business days, Away4 can delete Customer’s data without notice, after which data can not be recovered.

Away4 shall not be liable for direct or indirect loss or consequential damages, including but not limited to, for example, operating loss, loss of profits, lost earnings, loss of data and similar that the Customer or any third party may suffer as a result of defects, use or installation of services provided by Away4 . Compensation for Away4 can not therefore take place.
In any event, compensation may only amount to the amount that the Customer collectively has paid to Away4 in fixed operating expenses for the last 6 months prior to the event.

Moreover, Away4 is not responsible for any loss due to force majeure, including but not limited to regulatory, regulatory or similar measures, failure of power supplies, failure of telecommunications, breakdown of local systems at the Customer, lack of subcontracting, operating issues caused by either Customer or Away4 subcontractors, fire, smoke damage, explosion, water damage, vandalism, burglary, terror or tampering, strike, lockout, boycott or blockade.

Payment can be made by Credit/Debit card or via invoice. In case of payment via invoice, invoicing fee of 125, – per. collection. All services are invoiced 12 months in advance (period), unless otherwise explicitly stated. All periods are billed on the 15th of the month prior to the new period.
Paid period is not refundable, for example, in cases where Customer no longer needs the service.
Away4 uses Paylike ( as the payment gateway. Paylike stands for validation and management of card data. Away4 will not store cardholders card data, but reserves the right to cancel an order if card data is abused.

The service is interminable from the customer for the specified period, after which, unless otherwise agreed, it is automatically renewed for 12 months at a time. Termination must be notified to us in writing by the end of the month before the last month of the current period. Ie A period paid up to and including December must be terminated by the end of October, otherwise the service will automatically be renewed by 12 months.

Upon receipt of the order and / or payment, the purchased services will be available to the Customer. Invoice / receipt will be sent by mail the same day as order / payment is completed. The customer handles the required administration of the offered Away4 user account, including the creation and administration of users, etc
Away4 undertakes to keep all of the services offered, including but not limited to, updated and available.

10. DELETING CUSTOMER DATA (upon termination)
Upon termination of the Customer, for whatever reason, all Customer’s data is deleted, including without limitation email addresses, user data and registrations from all Away4 platforms, including backup and ERP systems. Deletion occurs 20 working days after expiration of the last period or after the last payment, after which data can not be recovered.

Away4 reserves the right to change prices without notice, for both free services and payment services. For price changes, already purchased services will remain active until the end of the period, and the price difference will not be charged until a new purchase is made. All prices are exclusive of VAT and are in DKK unless otherwise explicitly stated.

Any question concerning the interpretation or performance of this agreement, which can not be resolved in the minds of the Parties, is referred to a decision of the Sø- og Handelsretten in Copenhagen.
